Terms of Service

1. Agreement

By creating an account or using ExamRecall ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

ExamRecall is operated by ExamRecall ("we", "our", "us"). We may update these terms from time to time. Material changes will be communicated via the email address on your account at least 14 days before they take effect.

2. What ExamRecall provides

ExamRecall is a study tool for U.S. licensing and certification exams. The Service currently covers Life & Health Insurance licensing (NC, TX, FL, NY, CA) and the CFP® Certification Exam. It includes practice questions, mock exams, spaced-repetition review, an AI tutor, and readiness reporting.

What we do not provide: ExamRecall is not affiliated with any state insurance regulator, testing provider (Pearson VUE, PSI, Prometric), insurance company, or the CFP Board. We do not administer any licensing or certification exam, issue licenses or certifications, or guarantee that any individual will pass their exam. The Pass Guarantee, described below, is a contractual refund commitment — not a guarantee of exam outcome.

3. Account and eligibility

You must be at least 18 years old to use ExamRecall. By creating an account, you represent that you are 18 or older. The Service is intended for U.S. residents preparing for U.S. insurance licensing exams or the CFP® Certification Exam.

You are responsible for keeping your account credentials secure and for all activity under your account. Notify us at hello@examrecall.com if you suspect unauthorized access.

4. Payment and access

ExamRecall is a one-time purchase priced in U.S. dollars at $49.00, plus any applicable sales tax. Payment is processed by Stripe; we do not store your card information.

Access commitment: One purchase grants you access to the Service for as long as you need to pass your state licensing exam — with no recurring charges. After you pass, your account remains open as a courtesy, but our core commitment is access through your exam. Access may be terminated under Section 9 (Termination) or as part of a refund (Section 5).

Service discontinuation: We intend to operate ExamRecall indefinitely, but if we discontinue the Service we will provide at least 90 days' advance notice by email. Customers who have not yet passed their state exam at the time of the discontinuation notice are entitled to a pro-rated refund based on the time remaining in the 90-day notice period. Customers who have already passed their exam are not entitled to a refund upon service discontinuation.

5. Refunds and Pass Guarantee

We offer a Pass Guarantee. To qualify:

  • Score 90% or higher on a full-length ExamRecall Mock Exam taken within 3 calendar days before your scheduled exam date;
  • Sit for your exam and receive a failing result on your first attempt after purchasing ExamRecall;
  • Submit your official score notice (from Pearson VUE, PSI, or CFP Board, as applicable) to hello@examrecall.com within 14 calendar days of your exam date.

We reserve the right to verify the submitted score notice and confirm that the qualifying mock exam was completed within the Service. Claims that cannot be verified are not eligible for a refund under this guarantee.

Refunds are processed within 2 business days of approval to the payment method used at purchase. Once a refund is processed, your access to the Service is terminated.

The Pass Guarantee applies once per exam product per customer. It is the sole remedy for failing your exam. We do not offer refunds outside these terms except where required by applicable law.

6. Acceptable use

You agree not to:

  • Reproduce, distribute, or publicly display the questions, answers, explanations, or other Service content;
  • Resell, sublicense, or share access to your account with anyone else;
  • Use the Service to develop a competing product, including by scraping or systematically extracting questions;
  • Reverse engineer, decompile, or attempt to derive the source of the Service;
  • Use the Service in any way that violates U.S. law or the laws of your jurisdiction.

7. Intellectual property

All Service content — questions, explanations, mock exams, readiness algorithms, AI tutor outputs, the user interface, and the underlying code — is owned by us or our licensors and is protected by U.S. and international copyright law.

We grant you a personal, non-exclusive, non-transferable license to access and use the Service for the purpose of preparing for your own insurance licensing exam or CFP® Certification Exam. This license terminates automatically if your account is terminated or you violate these Terms.

8. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranty of any kind. We do not warrant that the Service will be uninterrupted, error-free, or that the questions cover every topic on your specific state exam. Exam content is set by state regulators and testing providers and changes over time.

We do not guarantee that any individual using the Service will pass their state licensing exam. Your performance depends on your preparation, the questions on your specific exam, and other factors outside our control.

9. Limitation of liability

To the maximum extent permitted by applicable law, our total liability to you for any claim arising out of or relating to the Service is limited to the amount you paid us for the Service in the 12 months preceding the claim.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you.

10. Termination

You may terminate your account at any time by contacting us at hello@examrecall.com.

We may suspend or terminate your account at any time if you violate these Terms or use the Service in a way that we reasonably believe is harmful to other users or to us. Material violations include account sharing, content scraping, and abuse of the Pass Guarantee.

On termination, your access ends immediately. Sections 5 (Refunds), 7 (Intellectual property), 8 (Warranties), 9 (Liability), and 11 (Governing law) survive termination.

11. Governing law and disputes

These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Wake County, North Carolina, and you consent to the personal jurisdiction of those courts.
